PAGA is an acronym for Private Attorneys General Act, and in the employment context, it is found in California Labor Code sections 2698-2699.5.
PAGA permits aggrieved employees to file lawsuits against their employer for Labor Code violations on their own behalf and on behalf of other employees. PAGA carries certain administrative hurdles, but also provides for penalties well in excess of what would be recoverable in a non-PAGA employment litigation.
These cases are on the rise in California, and the best manner to prevent them is to ensure that an employer is following the rules with regard to wage and hour laws. We are always available to assist with questions and compliance.
