    Hunt Ortmann Client Prevails With Major Victory In Construction Case

    Hunt Ortmann Palffy Nieves Darling & Mah, Inc. is pleased to announce a major victory for one of its clients reflected in a proposed statement of decision issued in June 2024, after a four week court trial in the fall of 2023. We anticipate a total recovery by our client in excess of $1,500,000.

    Our subcontractor client made a claim for a contract balance and three change orders against the general contractor on a high school project.  The contractor then assessed 43 negative change orders against our client totaling approximately $850,000.  The claims consisted primarily of charges for work by other subcontractors, including a purported replacement for Hunt Ortmann’s subcontractor client.  The court determined that Hunt Ortmann’s client was entitled to be paid for its entire contract balance and for all of its change orders.  41 of the 43 negative change orders asserted by the general contractor against our client were denied by the court.  Also denied were claims that our client and its lower tier subcontractors were not licensed.  The court concluded that our client was the prevailing party and is entitled to payments for interest on the outstanding amounts and recovery of attorney’s fees and costs.

    This outcome was achieved by the efforts of Senior Counsel Laurence Lubka, supported by shareholder Peter Schnaitman and the paralegal team of John Andrusko and Paul Pollard.
