Hunt Ortmann Palffy Nieves Darling & Mah, Inc. is pleased to announce an incredible victory for one of its clients last week after a school district reversed its claim on the client’s bid bond.
Last month, a new client approached the Firm who had been awarded a contract with a school district but had recently been denied the contract for not providing the contract documents timely. Because of the delay with receiving the contract documents, the school district had little choice but to proceed with awarding the project to the next lowest bidder, and as it was entitled to do, the school district also made a claim on our client’s bid bond for 10% of the bid amount.
Hunt Ortmann shareholder, Emily Kromke, spoke with the school district staff but they refused to reconsider their decision. Ms. Kromke then wrote to the school board directly, notifying them of the waste of public funds that would result from failing to give the job to our client. She then traveled to the school board meeting to provide public testimony concerning the intended waste of taxpayer money should the contract be awarded to a higher bidder. The school district then reversed its course and agreed not only to withdraw its bid bond claim but to also proceed with awarding the contract to our client.
