Hunt Ortmann Victoriously Represents USS Cal Builders in a Breach of Contract Action Against Martinez Steel
LOS ANGELES – On November 6, 2019, John D. Darling and Aaron J. Flores of Hunt Ortmann Palffy Nieves Darling & Mah, Inc., obtained a favorable jury verdict on behalf of their general contractor client, USS Cal Builders, Inc. The jury agreed that USS Cal Builders, Inc.’s subcontractor, Martinez Steel Corporation, breached the terms of its subcontract, installed defective rebar, and caused significant concrete defects that required costly repairs and project delays. The jury awarded USS Cal Builders, Inc. $577,349.75, the amount it withheld during the project under the subcontract’s terms and applicable statutes, and denied Martinez Steel Corporation’s claims for breach of contract and prompt payment violations. USS Cal Builders, Inc. will be filing post-trial motions seeking to recover its attorneys’ fees, expert fees, and costs.
