Hunt Ortmann Nieves Darling Mah Klein & Lozano, Inc. is proud to announce a recent court trial victory.
Our client, a roofing contractor, had completed a roof for a home owner association (“HOA”), and at the end of the job, the HOA claimed defects and incomplete work and refused to pay the balance on the contract. The HOA lodged a complaint with the Contractor State Licensing Board (“CSLB”) and the CSLB investigator found a number of deficiencies and fined our client. The HOA brought a cross-complaint seeking damages of over double the amount of the balance that was owed to our client.
Notwithstanding the CSLB findings, over the course of a two day bench trial, Hunt Ortmann associate, Jenna Karvunidis, was able to minimize the offsets through the testimony of our client and our retained roofing expert.
Together with cross-examination of the other side, Jenna proved up the bulk of what was owed to our client and defeated the cross-complaint in its entirety. The Court awarded our client a substantial amount of the balance sought plus costs.
